State moves ahead with illicit tobacco clampdown

The NSW parliament has passed a bill cracking down on the illegal trade of tobacco and vaping products. 

The reform introduces increased penalties and a new offence of commercial possession that carries a maximum of seven years in prison and a fine of up to $1.5 million.  

There are bigger fines for individuals and corporations caught selling tobacco without a licence, and inspectors will have new powers to prolong closures of businesses engaging in the illegal trade.  

The state government says the laws complement a new tobacco licensing scheme and will be supported by NSW Health’s new Centre for Regulation and Enforcement.  

“We are determined to disrupt the business model of large-scale criminals who profit from addiction, tax evasion and putting young people at risk,” NSW Health Minister Ryan Park said. “These laws aim to protect public health as well as protect small businesses that do the right thing.”
