Federal Court to hear gym’s covid BI case
A covid-related business interruption dispute between a Victorian fitness centre and Hollard is scheduled for a Federal Court trial on June 10-11.
Dates for filing submissions and objections were set out last Thursday by Justice Nicholas Owens at an administrative hearing in Sydney.
Joyo-Kin, as operator of Jetts Fitness Ocean Grove, is seeking cover for earnings lost due to state trading restrictions during the pandemic.
A court document filed by Shine Lawyers in 2021 says Hollard rejected the gym’s claim because an exception to a disease extension was triggered, while a prevention of access extension was not triggered.
The insurer argued there was no specific link between the gym “at the location and the government orders made in response to the Covid-19 pandemic”, the document said.
