AILA 'Causation Principles – The impact of the High Court's decision in Amaca Pty Limited & Ors v Ellis' Seminar

On 3 March 2010, the High Court handed down its decision in Amaca Pty Ltd & Ors v Ellis, finding that a man who had smoked between 15 and 20 cigarettes a day for a bit over 26 years and who had been exposed to asbestos in the course of his employment between 1975 and 1978, and later between 1990 and his death in 2002, was not entitled to damages in relation to the contraction of lung cancer.
