ASIC remakes financial advice class orders

ASIC has replaced “sunsetting” class orders regarding product advertising and financial advice with new secondary services and general advice legislative instruments.

It says the class orders have been remade without significant changes, so their effect will be preserved without disruption to those who rely on them.

The class orders are due to expire in October or next April, and the changes follow public consultation.

Instrument 2015/539 replaces class order 05/835 on general advice in advertising for product issuers.

Instrument 2015/540 “general advice warning” replaces class order 05/1195 “simplified warning for oral general advice”.

Meanwhile, ASIC Corporations (Financial Services Guides) Instrument 2015/541 replaces secondary services financial guide relief class orders for intermediaries and experts 04/1572 and 04/1573.

All the regulator’s class orders have sunset clauses, mostly covering 10 years.
